Age of Consent

Age of sexual consent is 14 years for heterosexual sex and 21 years for homosexual sex. The national legislation does not provide for a close-in-age exception.

Extraterritoriality & Extradition

Active extraterritoriality is provided for all SEC-related crimes including crimes committed by residents. Additionally, universal and passive extraterritoriality is contemplated for trafficking crimes as long as the offender is located in Madagascar’s territory. Double criminality principle is not applicable.

Extradition requires a minimum gravity of two years of imprisonment (therefore including all SEC-related offences). Double criminality is required.

There are no mandatory legal provisions for criminal background checks nor legislation prohibiting convicted sex offenders to hold positions involving or facilitating contact with children.

National Commitments

Madagascar has ratified the CRC, the OPSC, the Trafficking Protocol and the ILO Convention No. 182.

Madagascar has also ratified the African Charter on the Rights and Welfare of the Child.

Madagascar has not ratified the OPIC, the UNWTO Framework Convention on Tourism Ethics nor the AU Convention on Cyber Security and the Council of Europe’s Lanzarote and Budapest Conventions.
